Until these rules are officially notified, states have been directed to continue registering Anand Karaj marriages under existing legal provisions. However, legal experts and community leaders note that the Anand Marriage Act, even with amendments, remains limited in scope and does not comprehensively address the legal and civil challenges faced by the Sikh community.

The Anand Marriage Act: Origins And Significance

Enacted in 1909, the Anand Marriage Act was designed to formally recognise marriages performed through the Anand Karaj ceremony, the sacred ritual central to Sikh tradition. During the ceremony, the bride and groom circle the Guru Granth Sahib four times, representing their spiritual union and shared journey through life.

The original Act sought to distinguish Sikh marriages from Hindu rituals, reflecting the community’s distinct religious identity. However, the Act did not include provisions for marriage registration, which limited its practical utility in legal and administrative matters. As a result, Sikh couples faced challenges in proving marital status for inheritance, residence, maintenance, succession, and other civil rights.

Amendments And State-Level Inaction

In 2012, the Anand Marriage (Amendment) Act added Section 6, mandating that states frame rules to register Anand Karaj marriages. Despite this, most states and Union Territories failed to implement the rules for over a decade, leaving a legal vacuum for Sikh couples seeking official documentation of their marriages.

This prolonged inaction created difficulties in accessing rights that require proof of marriage, such as property claims, matrimonial benefits, and official identity verification, forcing many Sikhs to register marriages under the Hindu Marriage Act, 1955, which does not reflect their distinct religious identity.

Supreme Court Intervention

Following petitions highlighting state-level noncompliance, the Supreme Court intervened, issuing clear directives:

  • States and Union Territories must establish a neutral, effective registration mechanism for Anand Karaj marriages within four months.

  • Requests for marriage registration cannot be denied due to the absence of notified rules, ensuring Sikh marriages are uniformly recognised across India.

  • The court emphasised that the registration system must respect religious identity while ensuring civic equality, reinforcing the principle of non-discrimination.

This intervention marks a significant step in ensuring that Sikh marriages are legally recognised and protected under their own tradition rather than relying on laws designed for other communities.

Ongoing Challenges And Legal Gaps

Despite the Supreme Court’s directives, challenges persist:

  • Many Sikh couples still register marriages under the Hindu Marriage Act, as it offers a functional but religiously mismatched framework.

  • The Anand Marriage Act does not cover divorce, maintenance, or matrimonial disputes, forcing Sikhs to seek remedies under Hindu personal law.

  • Community leaders argue that the Act is symbolic rather than comprehensive, lacking the detailed legal provisions found in other personal laws.

There is a growing demand for a comprehensive Sikh marriage law that acknowledges religious customs while addressing civil rights, property succession, and family law matters.

Community Perspectives And Future Directions

Sikh leaders, scholars, and legal experts emphasise the need for a full-fledged Anand Marriage Act that:

  • Recognises Sikhs as a distinct community with specific legal rights.

  • Provides detailed provisions on marriage registration, divorce, maintenance, succession, and inheritance.

  • Balances religious practices with civil and constitutional rights, ensuring equality and protection under the law.

Developing such a law would not only strengthen the legal position of Sikh couples but also preserve the cultural and religious significance of the Anand Karaj ceremony, promoting a sense of legal and social security for the Sikh community nationwide.

The Supreme Court’s recent intervention is thus a major step toward legal recognition and uniformity, but the broader reform of the Anand Marriage Act remains essential for achieving a holistic, equitable, and culturally sensitive marriage law for the Sikh community.
